The Federal High Court in Abuja has dismissed a lawsuit filed by the All Democratic Alliance (ADA) against the Independent National Electoral Commission (INEC), citing a lack of merit. Justice Emeka Nwite ruled that the suit was incompetent as it was initiated through an originating summons, which is inappropriate for cases involving allegations of fraud. The judge emphasized that such allegations necessitate a writ of summons to allow for a full trial, including oral testimonies and cross-examinations, thereby ensuring the defendants' right to a fair hearing. Consequently, Justice Nwite set aside the proceedings and dismissed the case, affirming that the improper procedure rendered the suit unmeritorious.
