The Federal High Court recently made an important decision regarding Neconde, a company involved in oil production in Nigeria. The court ruled that First Bank's attempt to appoint a Receiver (a person or entity that takes control of a company’s assets) over Neconde's interests in Oil Mining Lease (OML) 42 was not valid. The judge stated that the lenders for Nestoil, which is connected to First Bank, could not take this action because the legal agreement (called the Deed of Charge) that would allow them to do so had not yet become official. As a result, the court declared the Receiver's appointment invalid and stopped the lenders from taking any further action against Neconde until the agreement is properly established. This ruling is significant because it protects Neconde's operations and assets, which are important for Nigeria's oil and gas industry. A representative from Nestoil expressed satisfaction with the court's decision and emphasized their commitment to working positively with all parties involved and to developing Nigeria's energy resources responsibly. Overall, this ruling clarifies that lenders must have their legal agreements fully in place before they can enforce their rights, which is crucial for businesses in Nigeria's energy sector.
